AGREEMENT?FOR?TENANCY?RIGHTS

THIS    AGREEMENT  MADE  ON  THIS  THE  _______   DAY  OF  _________month, _______   year.

 

                                                                        B E T W E E N

 

 

SRI/Smt. ________________________, S/D/W of  Sri/Smt _________________, __________ by religion, ________________ by occupation,  residing  at ____________________________________(Address with pin code), hereinafter called the “LANDLADY” (the expression of which unless excluded by or repugnant to the subject or context mean and include his legal heirs, representatives, administrators, executors and assigns) of the “FIRST  PARTY”

 SRI/SMT ___________________________,  Son/Daughter/Wife of ________________,  ___________ by religion, __________ by occupation,  residing at  _________________________________(Address with pin code), -  hereinafter called the “TENENT” (the expression of which unless included by or repugnant to the subject or context mean and include her legal heirs, representatives, administrators, executors and assigns) of the ”SECOND PARTY”.

 

WHEREAS  the  First Party had agreed to grant tenancy right to the second party a _________ building premises measuring about _______ Sq. Ft. at _________ Floor fully described in the schedule given below which is fully and solely owned by the first party, at a monthly rent of Rs.___________ (Rupees in word ) only per month on terms and conditions set-forth herein below.

 

AND  WHEREAS the second party had also agreed to take the tenancy  right of the aforesaid  premises described in the schedule given below from the first party on some terms and condition set-forth in the schedule.

 

AND  WHEREAS in order to avoid disputes, differences, misunderstanding and unpleasantness in future the parties have thought it proper and advisable to recer the terms and conditions of the agreement in writing which has been mutually agreed in between the parties.

 

 

NOW  THE  AGREEMENT  WITHNESS AS  FOLLOWS:-

  1. That the first party shall let out the said premises more specifically described in the schedule given below to the second party on monthly rental basis @ Rs. _____________  (Rupees in word) only and shall also be payable electric charges as per Meter reading to the first party and the first party shall accept the same subject to the term herein below stated.

 

  1. That the rent of the building premises shall commence from _______________(dd/mm/yyyy) and shall valid for a period of ______ months.

 

  1. That the tenancy month shall be began from the 1st day of every month of English calendar to the last day of every month and the rent of every month hereby reserved shall be paid by the second party in advance within the first week of every month or as mutually agreed and accepted by both the parties.

 

  1. That the tenant shall use the said premises for residential purpose only and shall not use the same for any other business or any other purpose or purposes.

 

  1. That the tenant shall handover the rental premises to the landlord in good condition on expiry of _____ months i.e. _______________(dd/mm/yyyy).

 

  1. That if the rents are not paid in terms of the agreement whether the same have been legally demanded or not if there shall be any beach of conditions herein contained by the second party it shall be lawful for the  landlord to entered upon any part of the premises in the name of whole and thereupon a tenancy shall immediately cease and determine.

 

  1. That the rates, cess, taxes etc. in respect of the premises shall be paid by the landlord. But if the rates and taxes are increased by central or state government during the tenancy period that shall be equally borne by the landlord and tenant both.

 

  1. That the second party shall not make any addition or alteration in the aforesaid premises without the written consent of the landlord.

 

  1. That the second party shall not sub-let the aforesaid rental premises or any portion thereof  to any body nor shall permit the same or any portion thereof to be occupied by any other person or persons.

 

  1. That the second party shall at her own cost affix or install in the premises    such fixtures as may be deemed necessary or safety of her rented premises against theft and burglary without causing any damages, addition or alteration of the tenanted premises, but causing the second party shall have no claims whatsoever over such fixtures and fittings or cost thereof at the time of termination of the tenancy and in this respect written permission should be obtained from the landlord in case of any such fittings and fixtures.

 

  1. That the second party shall allow and give facilities to the landlord or his authorized agents for the inspection, supervision of the aforesaid tenanted premises, with prior information and the time convenient to both.

 

  1. That the second party shall keep the premises in good and perfect condition normal wear and tear excepted.

 

  1. That the second party shall not be entitled to carry out any illegal or immoral business/activities in the rented premises.

 

  1. That the second party shall not keep or store any such sustains which is highly inflammable or combustible sustains nor shall install any permanent device of fix or engine in the premises which will cause nuisance or disturbance to other occupants.

 

  1. That the second party shall be allowed to use the common passage/s or court yards for the purpose of interim her premises but they shall neither store goods or any other material on the passage etc. (i.e. out side of her rented premises during, as well as normal hours nor shall have any claim whatsoever over such passage/s, court  yards of vacant a space).

 

  1. That the landlord shall be entitled the tenancy and entered upon possession forthwith.

 

  1. In case the rent falls into arrear for any two months,
  2. If the tenant commits breach of any of the other terms of this agreement of tenancy,

 

  1. That the landlord shall also give two months notice in writing to the tenant in case early termination of the tenancy Agreement.

 

  1. That the tenancy shall be governed by the provisions of  _________________(Name of State) Premises and Tenancy Act, 1956 subject to the terms and conditions as contained in this agreement.
