SRI/SMT  ____________________, Son/Daughter/Wife of _____________________, __________ by faith, citizen of india, ______________ by occupation, resident of ____________________________________________ (Address with pin code, P.O, P.S and District), hereinafter called the LAND OWNER/FIRST PARTY(which expression shall  mean and include unless excluded by or repugnant to the context her heirs, successors, executors,  representatives, administrators and assigns) of the ONE PART.

WHEREAS   the  First Party is the owner of flat  measuring about __________ Sq.ft. including ________(In word) Bed Room,  ________(In word) Sitting Room, _______(In word) Bathroom, _______(In word) Latrine & _________(In word) Kitchen, in the __________ Floor, situated at _________________________________ (Address with pin code, P.O, P.S and District).

WHEREAS  the First Party/owner in order to mobilize his resources of income and the Second Party/Tenant is in need of  room for his residential purpose (monthly rent basis) is desires to letting out the said flat more particularly described in the Schedule below.

WHEREAS the Second Party being need of a room for the residential purpose has approached the First Party with a request to let out the said building to him and has offered a monthly rent of Rs. ___________- (Rupees in word) only per month.

WHEREAS the First Party considering the said offer of the Second Party as fair, reasonable and as per prevailing market rates,  agreed to let out the said flat more particularly described in the schedule below at or for the consideration of monthly rent basis.

NOW  THIS  INDENTURE  WITNESSETH  that in view of the aforesaid offer and acceptance and the First Party does hereby agree to induct the Second Party as a tenant of the aforesaid flat with effect from the  _________  day of  ____________ month, ___________ year  subject to the terms and conditions as mutually agreed upon by them as enumerated hereunder:

 

      TERMS   AND  CONDITIONS

 

  1. That this agreement for tenancy shall commence and shall continue for ___________ (In word) month.

 

  1. That the monthly rent of the below schedule flat shall be Rs. _____________ (Rupees in word) only and shall be payable within the first week (______ day) of every month in advance.

 

  1. That the rent shall be paid against proper receipt issued by the room owner or any of his appointed representatives and payment of the rent without any proper receipts shall not be recognized.

 

  1. That non-payment of the monthly rent for continuous ________(In word) months within a period of the English Calendar year amounts to eviction.

 

  1. That the Tenant shall not be allowed for getting Electricity supply/connection by and through the land Lord and the Tenant  shall pay the monthly electricity consumption charges to the flat owner as per reading taken by flat owner/representative of  he land Lord/sub-meter on presentation of the bills.

 

  1. That Tenant shall pay Rs. ____________ per unit according to Sub-meter to the landlord.

 

  1. That the Second Party shall bear the major/minor repairs and maintenance only of the flat and at its/his/their own costs and of course with written permission of the First Party/flat owner.

 

  1. That the Second Party shall give vacant possession of the tenanted flat to the First Party after termination of the agreement.

 

  1. That the Second Party has deposited Rs. __________ (Rupees in word) only to the landlord which shall be adjustable in monthly rent.

     10. That if the flat owner requires the tenanted premises during the tenancy  period for his personal purpose them he                   shall  issue a notice in writing giving one month time to the tenant to vacate the said flat premises and the tenant                   shall have to vacate the tenanted premises.

     11. That the First Party shall have the right to inspect the below scheduled flat within the reasonable hours.

    12. That for any other matters which has/have not been specifically mentioned herein shall be decided according to the               provisions of ________________ (Name of State) Premises Tenancy Act, 1956 as amended and or repealed time to             time.
