DEED?OF LEASE?FOR REDENTIAL ACCOMODATION

   THIS  INDENTURE  IS MADE  ON THIS  THE  _____ DAY  OF  _________ MONTH,  ________ YEAR  AT  ________________ (NAME OF PLACE).

                                                                                                                                                                      

                                                                                 BETWEEN

 

SRI/SMT ______________________, Son/Daughter/Wife ___________________,  ______________ by religion, Indian by nationality, _____________ by occupation, resident of _____________________(Address with pin code), P.O. & P.S. _______________, Dist. ___________ in the state of ___________,- hereinafter called the LESSOR (which expression shall unless excluded by or repugnant to the context be deemed to mean and include his heirs, executors, administrators, legal representatives, successors and assigns) of the FIRST PARTY.

___________________, S/W/D of _______________, resident of ______________________________________(Address with pin code), hereinafter called the LESSEE (which expression shall mean and include unless excluded by or repugnant to the context her heirs, executors, successors, administrators and representatives and assigns) of the SECOND PART.

 

WHEREAS the Lessor is the absolute owner of a residential premises situated at __________________________(Address with pin code), P.O. & P.S. _____________, Dist. _____________ as fully described in the schedule below.

 

AND WHEREAS the Lessee in search a residential accommodation approach to the Lessor to lease out the aforesaid residential accommodation for a term of _________ (in word) months.

 

AND WHEREAS the First Party (Lessor) has agreed to the said proposal and to execute a DEED OF LEASE in favour of the Second Party (LESSEE).

 

                                                                                                                       

AND WHEREAS the Lessor have agreed to lease out the residential accommodation to the Lessee for a monthly lease fee of Rs. ______________ (Rupees in word) only for ______ (in word) months and the Lessee has agreed to take the same on lease for _______(in word) months as per the terms and conditions stated herein under :-

 

NOW  THIS  INDENTURE  WITNESSETH  AS  FOLLOWS:

 

  1. That the Lease in favour of the Lessee has been granted for a period of ______(in word) months from _____________(dd/mm/yyyy)
  2. That the Lessee shall pay to the Lessor for the premises for Rs. __________ (Rupees in word) only per month fixed strictly for the period of __________(in word) months.
  3. That the Lessee shall pay the monthly lease fee/rent of Rs. _______________ (Rupees in word) only on or before the _________ day of the English Calendar month as advance for the said month.
  4. That the Lease shall be commenced and effected from the _______ day of ___________ month, __________ year and lease shall handover the peacefully vacate possession of the said property described in the schedule below premises on _________ day of _________ month, __________ year.
  5. That the Lessee shall deposit the sum of Rs. ____________ (Rupees in word) only as interest free refundable security deposit to the Lessor, which shall be adjustable on last two month of lease period.
  6. That the Lessee shall be responsible to attend all minor day to day repairs such as bulbs and tubes  etc. at their own cost, but major repair shall be attended by the lessor. However  any damage injury to the premises due to negligence of lessee shall be repaired by the Lessee.
  7. That the Lessee shall not carry out any structural additions or alteration to the said premises without the written consent of the Lessor and will not damage of caused to be damaged any part or whole of the Leased premises.
  8. That the Lessor & Lessee may terminate the lease at any time during the period of lease by giving one month notice any breack of terms of this agreement by the lessee will be considered as termination of this lease agreement.
  9. That on expiry of the ______(in word) moths lease period, the lease stand terminated and the possession shall vest with the lessor, however in case if lease wants to extends this agreement for the further periods should give notice for the same before ______(in word) month of the expiry of the lease deed to the lessor, the lessor shall reserve his right for extension/refusal of next lease.
  10. That the Lessee shall not in any manner assign, transfer, sub- let or otherwise part with the possession of the said residential premises or any part thereof in favour of any person or party.
  11. That the Lessee shall use the said premises for residential purpose only.
  12. That the existing and further taxes like property tax levied by the municipal and local bodies etc. shall be paid by the Lessor.
  13. That in case of leassee’s failure to pay the monthly rent within the due date than the lease stand terminated and the lessor have the right to take the possession of leased property immediately.
  14. That on the expiry/termination of the Lease, the lessee hereby agrees with the lessor to yield and deliver to him peaceful vacant possession of premises in him entirety on the same conditions as it has been given by lessor subject to normal wear and tear.                                                                                                                 
  15. That in case of lessee’s failure to handover the vacate possession of the aforesaid property described in the schedule below premises to the lessor on the expiry of the lease period they shall be treated as mare trespasser and liable to pay Rs. ____________ (Rupees in word) only per day in lieu  for the wrong full possession of the premises. The  Lessor shall have every right to enter into the premises and take possession of the aforesaid property described in the schedule below premises, after the expiry of the lease period or its earlier termination.
  16. That the Lessee shall permit the lessor or his agents etc. to enter upon the demised premises for inspection and carry out repair etc. at any reasonable time, and it’s rent shall be increased @ _____ % on subsequent renewal.
  17. That there exist an Electric connection the name of the lessor in the building and lessee shall be bound to pay the Electricity bill as __________________(Short form of state electricity dept.). reading according to in due
