Administrators and assigns) of the ONE  PART.

SRI/SMT. _______________, SON/DAUGHTER/WIFE  OF  _____________, by religion ________, by occupation _______, by Nationality Indian, permanent resident of ________________(Address with pin code), P.O. & P.S. __________, Dist- ___________, and at present residing at ________________(Address with pin code), P.S__________, Dist- ___________,hereinafter called the “SECOND  PARTY/LICENSEE” (which expression shall mean and include unless excluded by repugnant to the context her heirs, executors, successors, legal representatives, administrators and assigns) of the  OTHER PART. The Licensee is represented by and through his _________(Relation) – ____________( Name Person) .

 

 WHEREAS  the FIRST  PARTY/LICENSORS  is the absolute owner of a  premises, identified as ________________________________(Address with pin code) of the __________________(Block/Panchayat/Corporation), within the jurisdiction of Police Station _______________, Dist- ____________, free from all encumbrances and charges whatsoever.

WHEREAS  the FIRST  PARTY/LICENSORS have let out and the LICENSEE has taken the said tenanted premises, as fully described in the Schedule appended below (hereinafter referred to as “PREMISES” for the sake of brevity), on a monthly rental of Rs. _______________ (Rupees in word) only, under certain terms and conditions as agreed to by and between themselves, with effect from _______ day of ______month, ______year  for _______ Months.

WHEREAS  in order to avoid all future disputes and differences and also to keep a record of the said terms and conditions, both the parties have agreed to enter into an Agreement to record the terms and conditions of the Tenancy as agreed to by and between them on the date of its creation.

 

NOW  THIS  INDENTURE  WITNESSETH  THAT  in pursuance of the aforesaid mutual agreement, both the parties above named do hereunto enter into this Agreement and bind themselves and each other with the said terms and conditions as agreed to by and between them and as hereinafter appearing.

 

                                                                    TERMS  AND  CONDITION

 

  1. That the monthly rent of the said premises had been fixed at Rs. ________ (Rupees in word) only payable in advance according to the English Calendar Month and the term of the tenancy is for ________ Months commencing from _____ day of _____month , ______year.

 

  1. That the monthly rent of the said premises is payable by the SECOND  PARTY/LICENSEE  to the FIRST  PARTY/LICENSORS  within ______ days of each month.

 

  1. That the LICENSEE/SECOND  PARTY  shall pay the charges for electricity (which is/shall be consumed in the said premises) within _______ days of the succeeding month to the FIRST  PARTY/LICENSORS  as per Bill.

 

  1. That the Second Party / Licensee shall deposit the said Monthly rent in the Bank Account No. _______________ of ________(Bank name), ________ Branch, ___________(Place with pin code), directly.

 

  1. That the SECOND  PARTY/LICENSEE  shall use the said premises for Residential purpose.

 

  1. That the SECOND  PARTY/LICENSEE  shall not be entitled to use the said premises for any illegal or immoral purpose.

 

  1. That the SECOND  PARTY/LICENSEE  shall not be entitled to store or keep any inflammable substance in the said premises.

 

  1. That the SECOND  PARTY/LICENSEE  shall not be entitled to store and keep any contrab and and/or prohibited goods/articles in the said premises.

 

  1. That the SECOND  PARTY/LICENSEE  will lookafter on upkeeping and cleaning of the said premises.

 

  1. That the SECOND  PARTY/LICENSEE  shall use the said premises as a man of ordinary prudence and shall take all proper and reasonable care for the same and shall be liable to compensate to the FIRST  PARTY/LICENSORS  for any loss or injury which might be caused to the said premises due to the fault and negligent act of the SECOND  PARTY/LICENSEE.

 

  1. That the SECOND  PARTY/LICENSEE shall not be entitled to cause any damage, but to make any addition and/or alterations in the said premises.

 

  1. That the SECOND  PARTY/LICENSEE  shall not create any nuisance in the said premises.

 

  1. That the SECOND  PARTY/LICENSEE  shall not sub-let or transfer possession of the said premises or any part thereof to any other person or party.

 

  1. That the SECOND  PARTY/LICENSEE  shall not block the common areas, passages and stair case of the building.

 

  1. That the expenses for major repairing of any normal damage or earth quake problem, will be bourn by the FIRST  PARTY / LICENSORS  and the expenses for minor repairing will be bourn by the SECOND  PARTY/ LICENSEE.

 

  1. That after expiry of the present term period of ______ Months, the SECOND  PARTY shall hand over physical possession of the said premises to the FIRST  PARTY.

 

  1. That if any difference of dispute arises, either side shall have to serve Two months prior notice in writing to the other side/party.

 

  1. That for any other matter or matters which are not specifically mentioned in this Agreement, the provisions of __________(State Name)  Premises Tenancy Act, shall be applicable.
