WHEREAS the Lessor is the absolute and exclusive owner of the entire building premises Three storied as fully described in the schedule herein below.

WHEREAS the Lessee being in need of a premises for the purpose of running their business of _____________________________________________, have approached the Lessor to grant lease of the building premises ___________ storied as fully described in the Schedule hereinbelow and accordingly offered a sum of Rs. ____________ (Rupees in word) only as monthly rent for the said premises.

WHEREAS the Lessor has accepted the said proposal of the Lessee and agreed to grant lease of the said entire building premises Three storied as fully described in the Schedule hereinbelow on the monthly rental of Rs. __________________ (Rupees in word) only.
WHEREAS in order to avoid future disputes and misunderstanding which may crop up between them in future, the parties herein deemed it expedient to keep the terms and conditions agreed upon by and between them duly embodied in a written Agreement of Tenancy and this Agreement of Tenancy is accordingly drawn up and executed by and between the parties herein under the following terms and conditions
NOW THIS INDENTURE WITNESSETH THAT in consideration of the rent hereinafter reserved and the covenants and conditions hereinafter contained to be observed and performed on the part of the Lessees, the Lessor doth hereby grant and demise by way of lease to the Lessee ALL THAT piece or parcel of the entire building premises Three storied as fully described in the Schedule hereinbelow TO HAVE AND TO HOLD the same unto and to the use of the lessee commencing from the _______ day of _______month__________ year at the monthly rental of Rs _____________ (Rupees in word) only.
- That LESSEE hereby covenant and agree with the LESSOR as follows:-
- That the monthly rent of the below scheduled premises is fixed at Rs. _______________ (Rupees in word) per month to be payable to the lessee in advance within first week of the current month .
- The monthly rent shall be enhanced/increased @ _____% on the existing rent after expiry of every _________ (in word) years and the Lessee shall have to pay the said rent time to time increased/enhanced, after expiry of every _____ (in word) years.
- The interior decoration work would be carried on by the Lessee at their own cost without causing any damage to the structures of the building/ premises fully described in the schedule below.
- The Lessees shall keep and maintain the premises clean, tidy, healthy, wind and watertight in all seasons and further in good and substantial repair, reasonable wear and tear and damage by fire or storm excepted.
- The Lessee shall not make any structural additions and alteration to the demised premises without the consent of the Lessor in writing.
- The Lessee shall use the demised premises for running the business of ____________________________ and she shall also be entitled to use the demised premises for any other lawful business therein
- The Lessee shall not sublease and/or assign or part with their leasehold premises or any part thereof to any person/persons whomsoever, without the written consent of the Lessor.
- The Lessee shall be entitled to get electric, telephone etc, connections in the leasehold premises directly from the concerned authority/authorities and in that case the Lessor shall issue No-objection Certificate (if required) to and in favour of the Lessee.
- That the Tenancy in respect of the aforesaid premises shall be regulated according to English Calendar month, commencing with the 1st day of each month and ending with the last day of the said month.
- That the corporation Tax, Cess, Land Revenue and any other statutory taxes etc. to all the concerned authorities in respect of the aforesaid premises shall be paid by the Lessor.
- That the Tenant shall allow the Landlord/Lessor or his authorized agent for inspection and supervision of the said premises at all such times, as and when the situation so demands.
- The Lessor hereby agrees with the Lessee as follows:-
- That the Lessor before delivering the possession of the leasehold premises, shall do the works of painting and electric wiring inside the premises
- That the Lessor shall do necessary maintenance of the leasehold premises time to time.
- That the Lessee, paying the rent hereby reserved and observing and performing the conditions and covenants herein contained, shall quietly and peaceably hold, possess and enjoy the demised premises, without any interruption and disturbance by the Lessor or any person claiming under or in trust for her.
- That the Tenancy shall be governed according to the provisions of the West Bengal Premises Tenancy Act, 1997 subject to the terms, conditions and stipulations mentioned hereinabove.
