The Multiversity, a registered society, registered under _________________(Name of State) Societies Act, founded by His Holiness _____________________________________(Name of Society), having its registered head office at __________________________________(Address with pin code), hereinafter referred to as the PURCHASER   (which expression shall unless excluded by or repugnant to the context shall  be deemed to mean and include its heirs, executors, representatives, administrators and assigns) of the Second Part.

 

WHEREAS the Vendors hereto have inherited the property described in the attached schedule from their father/mother ___________________________ who acquired the below scheduled landed property by virtue of Rectification Sale Deed No. ___________ for the year __________ registered on _______________(dd/mm/yyyy) (Original Sale Deed No. _______ for the year ______) in the office of Joint Sub-Registrar, ____________ executed by Sri/Smt _____________________, Sri/Smt _____________________, Sri/Smt _____________________and Sri/Smt _____________________, all sons/brothers/daughter of Late __________________, residents of Mouja _____________, then P.S. _____________, present P.S. _______________, Dist- _________________ and have been possessing the said landed property as more fully and particularly described in the scheduled attached with this deed hereto (hereinafter referred to as the said landed property) as the rightful owner and occupier without any interruption and encumbrances whatsoever.

 

 

AND WHEREAS the purchaser, a benevolent social welfare organisation having felt the necessity to acquire the said landed property to utilise the same for its activities of public welfare approached the vendors to purchase the said property at the marketable price to  be offered by the vendors

 

NOW THIS INDENTURE OF SALE WITNESSES THAT :

 

In pursuance of said offer and acceptance made by the Vendor and Purchaser respectively and in consideration of payment of a sum of Rs. _____________ (Rupees in word) Only truly paid by the  purchaser to the Vendor hereto on or before the execution of these presents and that  being the full consideration money of the said land (the receipt whereof the Vendor doth hereby admit and acknowledge as per memo of consideration hereunder written) and also in consideration of the covenant hereinafter contained the Vendor doth hereby grant, transfer, convey, sell, assure and assign unto the Purchaser.

 

All That piece of land measuring  _______(In word) kathas or __________ acres (with old structures)  be the same a little more or less in Mouja ______________, Plot No. _______________, Hal Khatian No.________________, Sheet No. __________, P.S. ________________, Dist. ______________ and more specifically described  in the attached Schedule of the property and hereinafter now are or is or heretobefore were or was situated , bounded, called, known, numbered described or distributed together with all paths, passage, ways, sewers drains dinette, water,  watercourse and all other former and ancients rights, lights, liberties,  benefits, privileges, advantages, easements, advantages and appurtenances whatsoever to the said property belonging or in anything appertaining thereto or usually held, used, enjoyed and occupied therewith  or reputed to belong or be reppurtenant thereto and the reversion or revisions, reminders and the rents issues and profits thereof  AND ALL the estate, rights, title, interest, claim and demand whatsoever both a law and in equity of the Vendor into and upon  the said property and every part thereof AND ALL the deeds, pattas, monuments, writing, evidences of title whatsoever relating to or concerning the said property and every part thereof which now or may hereafter be

 

in the custody, power control or possession of the Vendor or any person or persons from whom the said Vendor may procure the same without any lawful action or suit TO HAVE  AND  TO  HOLD  the same property and hereditements and premises hereby conveyed and granted to the said Purchaser absolutely forever free from all encumbrances  and  the  Vendor  doth  hereby  covenant  with  the  Purchaser    that notwithstanding any act, thing deed, matters whatsoever made done or executed or knowingly suffered to the contrary, the Vendor now has good right, full power, absolute authority and indefeasible title to grant, transfer, convey, sell the said land hereby sold or expressed or inherited to be sold transferred and conveyed to the said Purchaser or aforesaid and delivers vacant and peaceful possession of the said landed property to the Purchaser simultaneously with the execution of these presents  AND  the Purchaser shall and may at all time hereafter peacefully and quietly held possess and enjoy the said land or every part thereof and pay the rents  and taxes to the Governments authorities upon getting its name duly mutated in the B L L R O  concerned as well as in the office of local authorities and receive the rents issues and profits thereof without any lawful eviction, interruption, claim and demand whatsoever from any person or persons lawfully or equitably claiming from under or in trust for the Vendor or any of his predecessor-in-title and the said Vendors shall with and for all time to come keep the Purchaser indemnified from or against all charges, estates, encumbrances created by the Vendors or any of his predecessor-in-title and shall keep the Vendor free from all encumbrances whatsoever suffered by the Vendor  or  any person or persons lawfully or  equitably  claiming  under  him  as aforesaid FURTHER the Vendor and all persons having lawfully or equitably claiming any estate or interest upon the said land or any part thereof  from under or in trust for the Vendor shall and will from time to time or at all times hereafter at the costs and requests of the Purchaser, his heirs, executors, assign and legal representatives do execute or cause to be done and executed all such act, deeds, things and matters whatsoever for further, better and more perfectly assuring the title of the Purchaser to the said landed property and shall hand over all documents to and unto the Purchaser as  may reasonably be required by him.

 

The Vendor doth hereby declare that the land hereby sold fully described in the schedule hereunder has not been previously leased, mortgaged, sold nor in any way transferred. There is no chare, lien lispendents or any attachment against the said land. There is no case, suit or proceeding pending before any court of law against the said land. The said land is not a decretal property nor sold in auction nor attached in default of payment of rent or for maintenance and for alimony of any person. The said land is not a debater or trust property nor donated for the cause of worship of any Deity. The Vendor sold the said land while having good and marketable title and free from all encumbrances and delivered khas possession of the said land to the Purchaser free from all encumbrances.

 

If any of the statements made hereinbefore by The Vendor is found to be false, untrue or fraud is detected hereby by reason whereof the purchaser suffers any loss or is prevented from taking khas possession of the Schedule mentioned land then the Vendor along with his heirs, successors, representatives, administrators and assigns shall be liable to compensate the loss and to refund the entire consideration money at a time together with all costs and compensation and interest.

 

If in future any error or omission is transpired in this deed, the Vendor  along with his heirs and successors shall at the costs and expenses of the Purchaser do and execute or cause to be done and executed any supplement Deed or Deeds.

The land(with structures) hereby transferred is delineated with red border line in the plan map annexed herewith forming part of these presents.
