WHEREAS the above named Second party acquired the land measuring  __________ acre _________ (In word) Kathas __________ (in word) Chattaks from _________________, Son/daughter/Wife of  ______________________ of  __________________________________(Address with pin code, P.O, P.S, District and State) represented by his constituted Attorney ___________________ (Name) of _________________________(Address with pin code) by virtue of a Deed of Sale being document No. __________ for the year _________ registered at the office of Additional District  Sub-Registrar, __________ (Name of Place) on ____________(dd/mm/yyyy)  and since then said __________________(Name of Trust), _______________(Name of place) became the absolute and exclusive owner of the land fully described in the Schedule below having permanent, heritable and transferable right, title and interest therein free from all encumbrances and charges whatsoever.

WHEREAS the above named Second Party being in need of money for the development of their properties somewhere else has offered to sell the said land measuring  __________acre _________ (In word) Kathas __________ (In word) Chattaks ___________  fully described in the Schedule below.

WHEREAS the First party being interested has accepted the said offer of the Second party and agreed to have the said land and offered a price of Rs. ____________  (Rupees in word) only as fully and final consideration money for the said land.

WHEREAS the Second Party considering the said price so offered by the First Party as fair, reasonable and highest in view of the prevailing market rate of the land and agreed to sell the said land as fully described in the Schedule below into the Purchaser at or for the said consideration amount.

 

NOW THIS INDENTURE WITNESSETH AS FOLLOWS :-

That in pursuance of the aforesaid offer, acceptance and also in consideration of the said sum of Rs. __________  (Rupees in word) only paid in cash to-day by the First Party to the Second Party (the receipt whereof the Second Party does hereby acknowledge and grant full discharge from the payment hereof). The Second Party does hereby transfer unto the First Party he Physical possession of the said land described in the schedule below and makes over possession thereof together with all right, interest, whichever are belonging to or any way appertaining to the said land or any part thereof TO HAVE AND TO HOLD he same absolutely by the first party forever peaceably and quietly without any interference or interruption from he Second party or any person or persons.

 

The Second Party does hereby covenant with the First Party hat if for any defect in the title or the physical possession of the land hereby transferred or any part thereof or any act done or suffered to be done by the Second Party, the First Party is deprived of ownership or of possession thereof the land or any part thereof in future the Second party shall be liable to be return the Purchaser/First party the full or proportionate part of the said price as the case may be together with interest from the date of such deprivation or dispossession and the Second party shall be liable to pay adequate compensation to the First party for any other loss or injury which the First Party may suffer there from.
