AGREEMENT FOR COMMON WALL

THIS  INDENTURE  FOR  COMMON  WALL  MADE  ON  THIS  THE ______ DAY  OF _________ MONTH __________ YEAR.

SRI/SMT _____________________, Son/Daughter/Wife of ____________________, __________ by religion, ___________  by occupation, residing at ____________________________( Address with pin code, P.S, P.O and District)-  hereinafter called the SECOND  PARTY of the OTHER  PART.

 

WHEREAS  both the parties are own blood related brother/Son/Daughter/Sister and their respective Father/Mother/Brother/Sister ________________________  has already been gifted his land in between his above two sons/daughter in more or less equally  i.e. _______ Katha  and  ___________ Katha  situated at  ______________________________( Address with pin code, P.S, P.O and District), being their Gift Deed No. _______ & ______ dated _____________, registered by the District Sub-Registrar, _____________, District-__________________.

WHEREAS the above-named FIRST  PARTY  & the SECOND  PARTY, have their own respective Plot of homestead land just adjacent to each other under Mouza- ____________, Pargana – _____________, P.S. ___________, situated in Village Name/Ward No_________, Holding No____________, of ____________________(Block/Municipal Corporation), ____________ (Name of place), at ________________________________( Address with pin code, P.S, P.O and District), appertaining to Plot No._________, recorded to Khatian No. _______, within Mouza- _________, J.L. No. _______, Touzi No___________Sheet No. ___________ Sabek No. _______Hal Sheet No.__________.

 

 

                                                                                 A   N   D

 

WHEREAS both the parties are intends to construct the common wall in their respective land according to  Block/Municipal House building plan/______________________(Name of Govt. Development Authority) on the terms and conditions enumerated  herein below :-

 

  1. That both the above named First and the Second Parties have decided to construct pucca common wall upon their respective plot of land covering the area in equal proportion from the western side of the land of the First Party and Eastern side of the land of the Second Party and neither party shall  leave any  space from the either side.

 

  1. That costs and expenditures to construct in their common building wall shall be born by both parties in equal share i.e. at the rate of  ____% and neither party shall be entitled nor shall have power and authority to make any sort of addition and alteration without the consent of the either party at any time in future.

 

  1. That both parties shall be bound the common building  wall  from their respective side in well furnished and good condition at all times and neither party shall do or cause to the done any kind of work in the said common wall whereby the side of the common wall of the either party may be subject of any kind of damage or destruction in any way and manner at any time in future.

 

  1. That both the parties will make the common wall in their respective land  according to rules and regulations of Block/Municipal House building plan or any other authorities.

 

 

  1. That both the parties will not use any Ventilater, Door, Windows, or any other artificial works in the common wall.

 

  1. That  neither party shall have any objection in any way and manner in approving and passing the Building Plan or revised Building plan by the appropriate authority and both parties shall co-operate with  the either party in this respect in all way.

 

  1. That if any dispute arise to construct the common wall in their respective lands then the both parties will be responsible for that.

 

  1. That if any party i.e. 1st party & 2nd party wish to sell  or gift  in their own possession to any other parties according to this Boundary wall Agreement and other parties will be bound to obeys the terms & condition of the Boundary wall Agreement respectively.

 

  1. That the terms and conditions enumerated and contained in these  present  shall be binding and in force for ever upon the above named parties and their respective heir and heirs and neither party shall be entitled to withdraw the same in any way and manner at any time in future.

 

IN  WITNESS  WHEREOF  the parties hereto have set and subscribed their respective hands on the INDENTURE  FOR  COMMON  WALL  AGREEMENT  on the day, month and year first above written.
