AGREEMENT  TO  LEAVE  AND  LICENSE  FOR COMMERCIAL PREMISES


THIS  DEED OF AGREEMENT  MADE  ON  THIS  THE _________  DAY  OF _______MONTH __________YEAR.

SRI/SMT. _____________, S/D/W of  Sri/Smt _____________,  ________ by religion, ____________  by occupation, residing at _______________________________(Address with pin code), Post Office & Police Station-________, District- ________, hereinafter called the ?LICENSOR?  (Which expression shall unless excluded by our repugnant to the context be deemed to mean and include her successors and assigns).

   SRI/SMT. __________________, S/D/W of  _________________,  _______ by religion,   ____________  by      occupation, residing at ______________________________(Address with pin code), P.O. _________,         Dist- _____________.  Hereinafter called the     ?LICENSEE?     (Which expression shall unless excluded by our         repugnant to the context be deemed to mean and include her     successors and assigns).

 

        WHEREAS the Licensor is a owner in possession of a     shop/residence         Premises cum residential house measuring     _______ Sq.ft. (approx)         situated at ________________(Name of village/word no/local area),__________(Under City/Block/Panchayat) near         _______________________ fully described in schedule below    and the Licensor has agreed to     give and Licensee has agreed to take       the said Shop  Premises cum        residential house  for the         business/residence purpose  on  licensee       basis for a period of _______     months commencing from _____day ______month  ______year on     the following terms and conditions:

           

  1.     That the Licensor hereby agreed to give and the Licensee agreed to     take the said Shop/residence Premises situated at ______________________________(Name of village/word no/local area),      Near  __________________________,  __________(Under City/Block/Panchayat)on  Leave and Licensee   basis for a period of  ______ months  only  commencing from         ____ day ______ month _________ year.

 

  1.  That  the  compensation/ License fee is fixed for such use of said           Shop / residence  premises  is   Rs.  _________ (Rupees  in word) only  per  month. The said compensation/License fee shall be paid by the  Licensee regularly every month in advance by the _____  day  of every month.

 

 

  1. That this License is granted to Licensee to do any kind of lawful business /residence  only at the said  Shop/residence premises.

 

  1. That the Licensee shall not do any illegal activities or immoral activities in said Shop/residence premises and the Licensor shall not be responsible for any of act of Licensee whether legal or illegal being done in the said  Shop /residence Premises.

 

  1. That the Licensee shall pay electric bill to the  ____________(Name of State) Electricity Board as per meter reading of Electric Meter installed in the said Shop/residence  Premises as per meter reading / electric bill.

 

  1. That after the expiry of this agreement that is after _____ months if the Licensee fails or neglect to handover the peaceful vacant possession of said Shop  Premises to the Licensor, then the Licensee shall pay a sum of Rs. _______ (Rupees in word) daily till the date of handing over the vacant possession of Shop  Premises.

 

  1. It is hereby clearly understood and agreed between the parties that nothing in  these presents shall be construed to confer any legal rights of tenancy sub-tenancy,  lease, sub-lease etc. on the Licensee and that  the Licensee can enjoy the use of the  Shop  Premises temporarily only at the pleasure and will of the Licensor, subject to the terms and conditions of this agreement.

 

      8. That at least ________ (In word ) month notice is required from either party to terminate the agreement.

 

      9.  All existing rates, taxes and out goings in connection of the building premises are to be paid by the Licensor.

 

     10.  That the Licensee shall not do any act or thing which may harm or damage to the said Shop/residence premises                    and shall take proper care of the same as he would take incase of his own property and belongings.

      11.   That the Licensee shall not do any act or thing which may harm or damage the property of the Licensor in any way               whatsoever.

 

      12.   That the Licensee will keep the said premises in clean, decent and sanitary condition.

 

       13.   That the Licensee agrees to keep the said premises in the same condition as  it was given to him and any loss or                  damage to the property of the Licensor, the same shall be made good by the Licensee.

 

       14.   The Licensor or her duly authorized agent shall have the right to visit the said  Shop/residence  Premises at all                       reasonable times and to see its safety.

 

       15.   That the Licensee is not to allowed to make or permit to made any additions and alternations without the previous                written permission of the Licensor.

 

      16.   The Licensee cannot allow any other person or sublet the Shop Premises under any circumstances.

 

      17.   That this License can be renewed after the expiry of ______ months on fresh terms & condition to be settled                         between the licensor and licensee if the Licensor does not want to renew this agreement after _______ months                     then the licensee shall handover peaceful  vacant possession of the said Shop/residence  Premises to the                             Licensor.

 

     18. That in case the agreement is not renewed after ______ months, then the Licensee immediately on the expiry of this             agreement, removes itself, its employees, servants and agents together with all its articles and things and handover               the vacant possession of the said Shop/residence Premises to the Licensor peacefully and without any let or                         hindrance.

     19. That if the Licensor fails to handover the vacant possession of said Shop/residence  Premises to licensor  after the               expiry of _______ (In word) months or as per notice of one month for termination  of agreement by the licensor, them             Licensee shall pay a sum of Rs. _________ (Rupees in word)  daily to the Licensor till the date of vacating and                     handover of vacant  possession of said Shop /residence Premises to the Licensor.

   20. That the licensee shall not be entitled to transfer the licensee to any other person or allow any other person to occupy            the said Shop/residence Premises.

 

    21.  It is agreed by these presents that the  Licensee does not acquire any right, title or interest on the said                                   Shop/residence Premises in any manner whatsoever and would use/occupy the said Shop/residence Premises                     during the currency of this agreement as a mere licensee.

    22.  That in the event of licensee fails and/or neglect to pay the monthly compensation/license fees for any two months                 whether demanded or not or violets any of the terms herein provided or in law commits any nuisance or annoyance               to licensor or neighbours of residential building, the licensor shall be entitle to terminate the licensee earlier upon a               ______ days notice notwithstanding the facts that the contractual period has not expired and in  such case the                       licensee shall leave and  vacate the said Shop Premises and deliver the peaceful vacant possession of the said                     Shop/residence Premises to the licensor.

   23. That the License shall pay a sum of Rs._____________  (Rupees in word) only to the licensor as advance  money to             be adjusted with monthly  license fee  @ ___________ per month .

  24. That though this agreement is valid for 11months only but it will be renewed for a further  period of ________ to                      _________ months or will be renewed  till the entire sum of advance of Rs. ___________ is  liquidated  and  it is                    agreed  license fee/ compensation of Rs. ______________ per month  shall be increased every renewal  hereof  @              _____% after ________ months.

        ALL THAT  One  Shop  room cum residential house measuring ________ Sqft including  one shop room facing road, one kitchen, one bed room , one hall room, one bathroom and one toilet etc. situated at ______________________________________(Address with pin code), Near __________, , included in Plot No. _______, recorded in Khatian No. _______ of ______ Mouza, bearing Holding No. ________  of ________________(Block/ Corporation). 

 

            In witness whereof the parties to this agreement have set and subscribed there signatures on these presents on the _______ day, ____________, month and ___________year hereinabove first written.
