An Act to amend the Land Acquisition Act, 1894, as amended by Punjab Act II of 1954, in its application to the state of Punjab.
Be it enacted by the Legislature of the State of Punjab in the Seventh Year of Republic of India as follows: –
Statement of Object and Reasons: – Section 17 of the Land Acquisition Act, 1894, prescribes the procedure to be followed for taking immediate possession of land before the award is announced in case of urgency and for other purposes specified therein. This section, as amended by Punjab Act II of 1954, however, does not cover all the public purposes of importance for which possession of land may be required immediately by a Welfare State. To meet such cases the Act in question has been amended through the Land Acquisition (Punjab Amendment) Ordinance, 1956 (Punjab Ordinance No.4 of 1956). The Bill is designed to replace the said Ordinance. (Punjab Government Gazette Extraordinary, 1956, page 1090).
1. Short title. –
This Act may be called The Land Acquisition (Punjab Second Amendment) Act, 1956.
2. Amendment of section 17 of Act 1 of 1894 as amended by Punjab Act II of 1954. –
In sub-section (2) of section 17 of Land Acquisition Act, 1894, as amended by Punjab Act II of 1954, in its application to the State of Punjab, the following clause shall be inserted after the words “any public road” occurring in clause (b) :-
“(c) whenever land is acquired for a public purpose which in the opinion of the appropriate Government is of urgent importance.”
3. Repeal of Punjab Ordinance 4 of 1956. –
The Land Acquisition (Punjab Amendment) Ordinance, 1956 (Ordinance 4 of 1956), is hereby repealed.
